Terms & Conditions
By creating a Loanonline account or using the Loanonline services, you agree to be bound by these Terms and Conditions (the “Terms”). Please read them carefully before accessing or using the Loanonline website, mobile application, or any related online services (collectively, the “App”). If you do not agree with these Terms, you must not use the App.
The App is operated by pickerloan, a company registered in the Republic of Latvia under registration number 43603085405 (the “Company”). Any individual who accesses the App or applies for or uses Loanonline services is referred to as “User” or “you”.
pickerloan, together with its affiliates and subsidiaries, is referred to as the “pickerloan Group”.
Section headings are provided for convenience only and do not affect interpretation. Unless the context indicates otherwise, singular terms include the plural and references to any gender include all genders.
1. General Information
- The pickerloan Group provides an online platform that enables Users to submit applications and compare loan offers from third-party financial institutions and lenders (“Lenders”).
- By using the App, you acknowledge that the pickerloan Group acts solely as an intermediary between you and the Lenders. Any loan agreement is concluded directly between you and the selected Lender.
- The pickerloan Group is not a party to any loan agreement and bears no responsibility for the approval, terms, servicing, or performance of any loan provided by a Lender.
2. Processing of Personal Data
- By submitting information through the App, the User consents to the collection and processing of personal data in accordance with the Company’s Privacy Policy, which is incorporated into these Terms by reference.
- The User understands that providing personal data is necessary to receive loan offers from Lenders.
- Personal data submitted through the App may be shared with Lenders strictly for the purposes described in the App and in the Privacy Policy.
- The User authorizes the pickerloan Group to disclose personal data to Lenders and to trusted third-party partners for purposes including identity verification, credit assessment, service improvement, and presentation of relevant loan offers.
- The Company is not responsible for how Lenders process personal data once it has been transferred to them.
- The User agrees that Lenders and partners within the Loanonline network may contact the User regarding loan products or related financial services.
- The User also agrees that the pickerloan Group may use the provided contact details (including email, phone number, and address) to send marketing and promotional communications about products and services offered by the pickerloan Group and/or its partners, subject to applicable law.
3. User Responsibilities
- To access the Services, the User must complete the required information fields within the App.
- The User must use secure devices and reliable internet connections when submitting information.
- The User must not share account access with third parties. If the User suspects unauthorized access, the User must immediately notify the Company at support@pickerloan.ph.
- By applying for a loan, the User confirms that they have read and understood these Terms and the Privacy Policy.
4. Free Use of the App
- Access to and use of the App’s Services is free of charge for the User.
5. Limitation of Liability
The pickerloan Group provides information about loan offers but does not guarantee the accuracy or completeness of User-submitted data. The User is fully responsible for all information provided and for any transactions performed through the App.
The User acknowledges and agrees that:
- The pickerloan Group is not a party to any agreement between the User and any Lender;
- The pickerloan Group does not control and is not responsible for loan approval decisions, loan terms, or communications between Users and Lenders;
- The pickerloan Group is not liable for losses resulting from technical failures, device malfunctions, software issues, power outages, communication errors, or similar events;
- The pickerloan Group is not responsible for actions taken by third parties who gain unauthorized access to the User’s account.
6. General Use
- The User agrees to comply with all instructions, procedures, and technical requirements related to the App.
- The User is solely responsible for maintaining the confidentiality and security of their account credentials and registered device.
- The User must not allow their username or password to be used for any unlawful or unintended purpose.
- Use of login credentials and device biometrics constitutes the User’s authorization for transactions performed in the App, which will be considered valid and binding.
- The pickerloan Group is entitled to rely on instructions received through the User’s account without further verification.
- The User must promptly notify support@pickerloan.ph if:
- the registered device is lost, stolen, or malfunctioning;
- account security may have been compromised; or
- the User changes their registered phone number or device.
The User remains responsible for all transactions made before such notice is received.
7. Accuracy of Information
- The User guarantees that all information provided is accurate and complete. The pickerloan Group is not liable for errors resulting from incorrect information submitted by the User.
- The User is responsible for any losses arising from failure to report inaccuracies or from negligent or fraudulent behavior, including failure to safeguard login credentials.
8. Termination of Service
- The User may request termination of their App access at any time.
- The pickerloan Group may terminate access for any reason by providing seven (7) calendar days’ notice.
- Immediate termination without prior notice may occur if:
- the User breaches these Terms;
- the account remains inactive for twelve (12) consecutive months; or
- the pickerloan Group reasonably determines termination is necessary.
9. Assignment
- The User may not transfer their rights or obligations under these Terms.
- The pickerloan Group may assign or transfer its rights and obligations without User consent.
- Following any transfer, the User remains bound by these Terms.
10. Cumulative Remedies
- All remedies available under these Terms are cumulative and do not exclude any rights available under applicable law.
11. Waiver
- Failure or delay by the pickerloan Group to exercise any right shall not constitute a waiver of that right or any subsequent breach.
12. Severability
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. Governing Law and Jurisdiction
- These Terms are governed by the laws of the Philippines.
- Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts of Manila, without prejudice to the pickerloan Group’s right to initiate proceedings in any other jurisdiction where the User’s assets may be located.
14. Binding Effect
- The User confirms that these Terms have been read and understood and agrees to be legally bound by them. These Terms shall be binding upon the User and their heirs, successors, and permitted assigns.
15. Changes to Terms
- The pickerloan Group may modify these Terms at any time. Users will be notified at least thirty (30) calendar days before the changes take effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
16. Reporting Concerns
- Users may submit inquiries or complaints to support@pickerloan.ph.
- The User agrees to undergo reasonable verification when contacting the pickerloan Group.
17. Intellectual Property
All intellectual property rights in the App and its content belong to the pickerloan Group or its licensors, unless otherwise stated.
